Hiker indicted in fatal shooting on trail

A Coconino County grand jury late Thursday handed up an indictment for second-degree murder against a retired Valley teacher in a fatal shooting along a trail north of Payson.

Harold Fish, 57, is scheduled to be arraigned on the charge next Friday in Coconino County Superior Court.

Fish's attorney, former U.S. Attorney Mel McDonald, said Friday that the charge against his client is an outrage.

"I'm awaiting the transcript to see whether the County Attorney's Office even tried to make a fair presentation of the evidence," McDonald said, adding that he is likely to file an appeal to overturn the indictment.

Grant Kuezli, 43, was killed May 11 in a confrontation along a forest trail where he was camping.

Fish, said he shot Kuenzli three times in self-defense after two of Kuenzli's three dogs and then Kuenzli charged at him.

Coconino County prosecutors filed a second-degree murder charge last month against Fish in the Flagstaff Justice Court before taking their case to the grand jury on Thursday in Flagstaff.

Prosecutors sought the charge despite the lead detective's conclusion that Fish was justified in defending himself and shooting Kuenzli.

Fish said he fired a warning shot at Kuenzli's dogs to stop them, only to look up and see Kuenzli running at him on the trail screaming: "I'm going to kill you, you son of a (expletive)!"

Fish was not injured by the dogs that scattered after the shooting. The dogs remain in a Flagstaff animal shelter.

Did the two guys know each other before this confrontation or did Fish just go straight to panic mode when the dogs came after him?

hmmm... so packing heat is only a good self-defense in what case? A shoot out?

NO.....that's what get's me, this Fish guy went NUTZ and starting shooting when the dogs "attempted" to charge him. At first, the Az Attorney General called this a *justified shooting* but after some lengthy investigations, they determened this Fish guy WAS indeed NUTZ!
