The circulation structure of a surface low over warm water is just as important as convection persisting.
You can't have a tropical cyclone form without a surface low pressure circulation. I have seen storms come and go without convection for a time and then they develop it around the center and become tropical depressions, tropical storms and/or hurricanes.
Convection falling apart several times doesn't mean tropical cyclogenesis won't occur, just as much as convection can fire up several times without a surface low.
