Soldier charged in grenade attack

FORT CAMPBELL, Ky., April 4 — A soldier from the Army’s 101st Airborne Division has been charged with two counts of murder in a grenade attack on officers’ tents in Kuwait, it was announced Friday.

FORT CAMPBELL officials said Sgt. Hasan K. Akbar, 32, was charged under military law on March 25 with two counts of premeditated murder and 17 counts of attempted murder.Akbar, who also was charged with one count of aggravated arson of an inhabited dwelling and misbehavior as a sentinel, could face the death penalty if convicted of the most serious charges against him, according to Dennis Olgin, a retired judge advocate general’s corps officer who served 20 years with the Army

Just curious, how did he escape the most serious charge of treason. He clearly made war against his own countrymen during the time of war

Derek his accused crime does not fit the legal definition of treason:

Treason. A breach of allegiance to one's government, usually committed through levying war against such government or by giving aid or comfort to the enemy. The offense of attempting by overt acts to overthrow the government of the state to which the offender owes allegiance; or of betraying the state into the hands of a foreign power. Treason consists of two elements: adherence to the enemy, and rendering him aid and comfort.


It would have been a tough case to prove that he was "levying war against such government or by giving aid or comfort to the enemy". The apparent motives seem to have more to do with disiplinary actions taken against him. I guess we'll have to see how the trial unfolds.
