the Constitution does not prohibit my punishments... that just cannot be UNUSUAL. My punishments would be the USUAL punishment for convicted felons.

My suggestion was to just set him free, no jail time. The catch is that he should be released on Wall Street at a well-advertised time and place with no law enforcement officers present.

I can just see the Las Vegas odds..... How long would he survive? Would he be beaten, shot, stoned? etc...

I read about one disgruntled investor who put in 150K and is getting reimbursed 150K but wants the 600K that Madoff told him that his account was worth. ????? I would like to remind him that it was all BS all the time and be happy you are getting your 150K back. The 600K was pure fiction.

Do you suggest he be killed for ripping people off? I dont think so....

Besides life in prison is worse than death IMO...Sometimes death is the easy way out for these criminals.

No, I suggest that others out there will try to kill him. The safest place he could be is in prison. And, I agreee that life in prison is worse than death. Now he gets to see himself become a trivia question on a game show.

100% true. However, Madoff committed massive fraud. Calculated market risk is different from fraud.

Fraud is also massively illegal, illegal activities shouldn't have to be considered by investors.

I've read the letters that Ebbers secretly sends to Mamaw....he expected a pardon from Bush. HA!!!! It didn't happen.

The reason we remember those two examples are that they are the exceptions, not the rule. As in gambling, there are rules. When you break those rules it is called cheating. In investing, it is called fraud. Both are about managing risks from a position of partial knowledge. When one party has changed the rules so the outcome is always favorable, there is no risk involved. The capitalist system is that of risk vs. reward. "Do not invest" is a bit extreme. "Invest Prudently" is a better way to put it. The most basic rule of investing is to diversify. Do not place all your eggs in one basket. But, it is hard to argue with 15% or more returns a year for 10+ years. There are a lot of people involved who got more out than they originally put in. But now, they have nothing. It is very sad.
