
I understand why people are upset about this ruling (I find it more than a bit disturbing myself)... but I am not sure that the judges are completely to blame. As far as I remember, there is nothing in the Constitution that would stop emminent domain from being used to take land for "economic development."
However....couldn't we, on a state-by-state or even a national level, insist on legislation that would limit the scope of things governments could consider "economic development" appropriate for the invocation of emminent domain? Couldn't we create some sort of oversight structure that would adequately filter out the cronyism? I know the reaction to this decision has been quite negative across the board....surely we could rustle up enough votes for it...???
Wouldn't that be a bit more constructive than tearing down a judges house out of spite?
