At least he was smart enough to refuse the breathalyzer. He'll probably get off, even if he did it. Does Oregon have the "implied consent" rule where if you refuse a breathalyzer you automatically lose your drivers' license for a year?

Seriously though, it doesn't seem like it would take more than a beer, possibly two, for a man of his stature to be over the legal blood/alcohol limit. Even still, the worst thing that you can do is REFUSE to co-operate with a law enforcement officer and REFUSE the breathalyzer test. It doesn't help your case in court at all!

Thanks for finding that. I'd still rather do that than be caught up in the DUI witchhunt. Here in Florida, at least, the DUI conviction rate is very low for people who refuse the breathalyzer.

This is completely untrue. They have a hard time convicting for DUI for people who refuse the breathalyzer. Remember, when they suspect you of a crime the cops are not on your side.

Even though I am unable to use them right now, I still carry Class A CDL's. Which means that I cannot refuse any breathalyzer or blood/alcohol tests without automatically losing my license. Class A's mean, in the eyes of the law, that I am a professionally trained driver and there is ZERO tolerance for any amount of alcohol on my breath or in my blood when I am behind the wheel of ANY vehicle, even my personal car. A DMV officer even warned me to be careful about using Listerine in the morning due to the amount of alcohol in that product!!! How crazy is that??!! I've never had any problems with that,thank goodness but, I guess that my commentary comes from being in a position where I am held to a higher standard than one who retains a regular drivers' license.

Apparently, this was not his first "mistake". According to the news story, he had a previous DUI charge that was dropped after some kind of treatment program.

My question is, how many drinks/beers/cocktails what have you, would it take for someone of his stature to be over the legal blood/alcohol limit? It would seem that it wouldn't take the poor guy drinking too much to be legally over the limit. It's gotta' be hard for him to just have "mini" drinks while living in a much larger world. Going out for a couple of "cold ones" with the guys seems to have him at an early disadvantage.

Either way, hire a driver or take a taxi cab home. One night of fun could ruin someone's forever.

Very true, his leg disabilities would prevent that. I would find it highly unlikely that a police officer would even ask him to do that as a basis for a sobriety test. That would be kind of dumb but, as of late, I've heard some pretty dumb things in this forum too! Like some guy playing "Stick 'Em Up" with a couple of police officers!! Now, that was pretty dumb!!!

yes, he made a mistake no excuse about it.
people just don't get the message... Dont drink and drive. DONT ever drink and drive. Geez, what will it take for the point to get across to everyone... just don't do it. People are killed for no reason, and people are someone's loved one, maybe someone's mom or someone's dad, someone's daughter or someone's son, a brother or sister, a grandmother or grandfather, a niece or nephew.... a best friend maybe, whoever ends up getting the raw end of the deal belonged to someone. And there can be no excuse for drinking and driving, no matter if you are just a regular person or a tv star or the president of the United States, nothing that anyone can say will bring back a loved one if they get killed by a drunk driver.

yet, i still like Matt Rolloff and his family and i love the show on TLC (new season starts in the Fall) ..and i will be watching it.

he refused to take a breath test, and there are other tests they give people who are physically handicapped.
